Leadville Race Series Giveaway - Terms & Conditions
NO PURCHASE IS NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE THE CHANCES OF WINNING.
1. Agreement to Rules: By participating in the giveaway outlined herein (the “Giveaway”), you, the participant (“You” or “Your”), agree to be fully and unconditionally bound by these Giveaway rules and the terms and conditions set forth herein (collectively, the “Rules”), as established by Skratch Labs LLC (“Skratch Labs LLC”, “We”, or “Us”). You represent and warrant that You meet the eligibility requirements herein. In addition, You agree to accept the decisions of Skratch Labs LLC as final and binding as it relates to your participation in the Giveaway, the execution of the Giveaway and the interpretation of these Rules.
2. Giveaway Rules: In order to enter the Giveaway, You Must:
i. Fill in the required information as provided on the official Skratch Labs Leadville Race Entry Giveaway Landing Page; and
ii. Confirm that You have read the Rules prior to submitting Your entry.
3. Giveaway Eligibility: This Giveaway is open only to those who (i) comply with these Rules, (ii) are eighteen years old as of the date of entry, and (iii) are legal residents of the United States. The Giveaway is subject to all applicable federal, state, and local laws and regulations, and is void where prohibited by such laws.
4. Giveaway Period: The Giveaway will run from April 8, 2024 at 9am MST until April 18, 2024 at 9am MST. The winners will be notified via the individual’s email provided in entry submission.
5. Prizes: The 8 winners of the Giveaway will receive a reserved entry for the race of their choosing provided in their submission form or one Skratch Labs Spring Merchandise Prize Pack.
The following races will include a paid entry:
i. Leadville Marathon
ii. Leadville Heavy Half Marathon
iii. Silver Rush 50 Mile Bike Race
iv. Silver Rush 50 Mile Run Race
v. Leadville Stage Race
*The following races will ONLY include an entry, winner MUST PAY ENTRY FEE upon winning:
i. Leadville 100 Bike Race*
ii. Leadville 100 Run Race*
Skratch Spring Merchandise Prize pack is valued at $200 and contains one of each of the following: Skratch Labs Spring 2024 Assos Cycling Jersey (winner’s size choice, subject to availability), Skratch Labs Spring 2024 Fractel running hat, Skratch Labs Spring 2024 Specialized 22oz water bottle, Skratch Labs Spring 2024 100% cotton bandana, Skratch Labs Spring 2024 cotton t-shirt (winner’s size choice, subject to availability).
No cash or other prize substitution shall be permitted except at Skratch Labs LLC’s sole discretion. Prizes are non-transferable. Any and all prize-related expenses, including without limitation any and all federal, state, and/or local taxes, shall be the sole responsibility of the winner. No substitution of prize or transfer/assignment of prize to others or request for the cash equivalent by the winner is permitted. Acceptance of prize constitutes winner’s express and unconditional permission for Skratch Labs LLC to use the winner’s name, likeness, and entry for purposes of advertising and trade without further compensation to the winner, unless prohibited by law.
6. Winner Selection and Notification: The winners will be notified by the email they provided in their submission form. If winners do not respond within 5 days of notification, a new winner will be selected at random from the pool of applicants. Receipt by winner of the prize offered in this Giveaway is conditioned upon compliance with any and all federal, state, and local laws and regulations. ANY VIOLATION OF THESE RULES BY THE WINNER (DETERMINED AT SKRATCH LABS LLC‘S SOLE AND ABSOLUTE DISCRETION) WILL RESULT IN WINNER’S IMMEDIATE DISQUALIFICATION.
7. Terms & Conditions: Skratch Labs LLC reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend the Giveaway should virus, bug, non-authorized human intervention, fraud, or other cause beyond Skratch Labs LLC’s reasonable control corrupt or affect the administration, security, fairness, or proper conduct of the Giveaway. In such a case, Skratch Labs LLC may, but is not required to, select the winner from all eligible entries received prior to and/or after (if appropriate) the action taken by Skratch Labs LLC.
8. Indemnification; Limitation of Liability; Disclaimer of Warranty: By entering, You agree to release, indemnify, defend and hold harmless Skratch Labs LLC and its Members, subsidiaries, affiliates, advertising and promotion agencies, partners, representatives, agents, successors, assigns, insurers, employees, officers, and directors from any liability, illness, injury, death, loss, litigation, claim, or damage that may occur, directly or indirectly, whether caused by negligent or willful acts or omissions, from: (i) Your participation in the Giveaway and/or Your acceptance, possession, use, or misuse of any prize or any portion thereof; (ii) technical failures of any kind, including but not limited to the malfunction of any computer, cable, network, hardware, or software, or other mechanical equipment; (iii) the unavailability or inaccessibility of any transmissions, telephone, or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Promotion; or (v) electronic or human error in the administration of the Giveaway or the processing of entries. IN ANY EVENT, SKRATCH LABS LLC’S AGGREGATE TOTAL MONETARY LIABILITY TO YOU UNDER ALL CAUSES OF ACTION AND ALL THEORIES OF LIABILITY (INCLUDING BUT NOT LIMITED TO STATUTORY, TORT, STRICT LIABILITY, WARRANTY, INDEMNITY, CONTRIBUTION, AND CONTRACT THEORIES) WILL BE LIMITED TO THE MONETARY VALUE OF THE PRIZES AWARDED TO THE WINNER HEREUNDER. WITHOUT LIMITING THE FOREGOING, EVERYTHING IN THESE RULES AND IN THIS PROMOTION, INCLUDING, WITH THE EXCEPTION OF SKRATCH LABS LLC’S STANDARD LIMITED PRODUCT WARRANTY, THE PRIZES AWARDED, ARE PROVIDED “AS IS’ WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO ALL ENTRANTS. EACH ENTRANT SHOULD CONSIDER SUCH ENTRANT’S LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
9. Disputes: THIS Giveaway IS GOVERNED BY THE LAWS OF COLORADO, WITHOUT RESPECT TO CONFLICT OF LAW DOCTRINES. As a condition of participating in this Giveaway, participant agrees that any and all disputes that cannot be resolved between the parties, and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Boulder, Colorado having jurisdiction. Further, in any such dispute, under no circumstances shall participant be permitted to obtain awards for, and hereby waives all rights to, punitive, incidental, or consequential damages, including reasonable attorney’s fees, other than participant’s actual out-of-pocket expenses (i.e., costs associated with entering this Giveaway). Participant further waives all rights to have damages multiplied or increased.
10. Winners List: To obtain a copy of the winners’ names or a copy of these Rules, mail Your request along with a stamped, self-addressed envelope to: Skratch Labs LLC, 2845 29th St, Unit B&C, Boulder CO 80301.
11. Sponsor: The Sponsor of the Giveaway is Skratch Labs LLC, 2845 29th St, Unit B&C, Boulder CO 80301. Life Time and Leadville Race Series do not sponsor or bear liability for this promotion.
12. Social Media Release: The Giveaway hosted by Skratch Labs LLC is in no way sponsored, endorsed, administered by, or associated with Strava. You hereby expressly and unconditionally agree to release and hold harmless Strava, its shareholders, officers, directors, Members, Managers, employees, affiliates and agents from any liability, damages, losses, costs or expenses incurred by You in association with the Giveaway.
